All U.S. employers are responsible for completion and retention of Form I-9 for each newly hired individual they employ in the United States. This includes citizens and non-citizens.
The U.S. Customs and Immigration Service (USCIS), has updated the Form I-9 used for recording new hire information and verification of employment eligibility status. As of November 7, 2007, the Form I-9 with a revision date of June 5, 2007 is the only version of the form that is valid for use. The revision date of the Form I-9 is printed on the lower right corner of the form and states “(Rev. 06/05/07)N”.
Both the revised form and the “Handbook for Employers, Instructions for Completing the Form I-9” are available online at www.uscis.gov
Changes on the newly revised I-9 Form are mostly under list "A" of acceptable documents that establishes both the employee’s identity and employment eligibility. One document has been added to the list, and five have been removed:
Added was the Unexpired Employment Authorization Document (I-766) which is included with all of the other Employment Authorization Documents that contain photographs that are in circulation (I-688, I-688A, I-688B) as one item on List A.
Five documents removed to reflect the document-reduction requirements of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 are:
- Certificate of U.S. Citizenship - Form N-560 or N-561
- Certificate of Naturalization - Form N-550 or N-570
- Alien Registration Receipt Card - I-151
- Unexpired Reentry Permit - Form I-327
- Unexpired Refugee Travel Document - Form I-571
